Environmental HealthLesson 3: Local LawsLocal laws pertaining to New York City Local Law 38Local Law 38, passed in 1999, amended the administrative code of New York as it relates to childhood lead poisoning. The law basically states that in order to prevent lead poisoning to children landlords are required to remove any paint that is currently not in good repair or, repair any deteriorated sub surfaces in dwellings units that have children who reside in them under the age of six (6). Landlords are responsible for ensuring that the following precautions take place when renting an apartment to a tenant: A.) Tenants fill out the Lead-Based Paint Certification in order to determine if children under 6 reside in the apartment. B.) If children under the age of six reside in the apartment, inspect the apartment to ensure that all existing paint is intact. C.) Address all potential Lead hazards noted during the inspection. D.) Utilize safe work practices when addressing any lead hazards.
