"Out of curiosity does anyone know if the conman's site is open again yet? Quite funny how he shut it down. Like the boy who took his ball and went home. jim"

Nope, he just took his ball and went home. There is no notice to his paying customers or anyone else about the sudden closure of his censored boards or any plans to reopen them.

Shutting down his Brinkerbot worshiper pages is the best thing he could have for his subscribers. It forced the ones that need an Internet info fix to go look for other sources of info on Brinker and QQQs. Once his disciple get over the idea that they were worshiping a false idol, they will be better than they were wasting time on the censored Brinker boards.

In response to message posted by Will_L:

". I'm still not certain that the bulletin he sent in October could not result in some legal liability, judging by how many brokers have been sued successfully for recomending "inappropriate" investments. Thirty percent of someone's portfolio sent into this trade with little guidance or followup and no explanation of risk "appropriate". I dunno but I'm guessing he's sweating a little. "

I'm not a laywer, but his advice was so risk inappropriate that I expect is is open to legal action. Whether he wins or loses, he stands a good chance of spending a bunch on lawyers to defend himself against a bunch of laywers working on contingency.

He gave specific advise to "conservative" investors with no discussion of the risk, made it sound like almost a sure thing, and wrote the instructions in a way that an ultra conservative 100% in cash investor could think he was advising them to put 30% of their cash reserves into QQQs. Brinker left it hanging out there. I hope someone gets a big piece of him.

In response to message posted by ACousins:

"Oh yes, what in the world is wrong with summaries of a free radio program? Critics are always summarizing and criticizing shows, programs, movies, etc. "

When you're perfect, it's difficult to accept criticism. next step, a members only radio show on pay per view, then no show when he can't control that.

What happend to the discussion forums on Bob's site? Did he end all of the forums because he did not like people second guessing him, or are the down because technical difficulties? I talked to customer service, and the customer service rep said the forums would be up again soon. That was last week.

Even the chat room #bobbrinker.com at babylon.beyondirc.net has been changed. I tried logging in, but I get the error message "you have been banned". Note that the chat room has not been shut down, it has been changed to deny admittance.

RE: I hope someone gets a big piece of him.

No, I Hate to see lawyers get rich protecting people from their stupidity. Spilling coffee and suing McDonalds or taking "I can read the future" advice from a guy on the radio and thinking he owes you anything other than a refund for unsent newletters is wrong. Work to discredit the advice giver or help educate the public, but lets not give a bunch of people an easy out (sue somone) for doing something not too bright. This just ends up hurting everyone as those trying to give free advice to help people might stop as they could be sued.

Would you sue the gypsy at the carnival if the fortune she tells for you doesn't come true?

Part of healing and growing is admitting you made a mistake, saying what you learned and THEN moving on to do better in the future. Many here have made this discovery the past few weeks.

BTW, remember all the times I said how important it was that Bob was predicting a big rally off the DJIA "bottom" of 8650 in 1998 and all the Bots wanted to tell me how smart he was for "calling the bottom at 7900" when he said "you can't afford to be out of the market even one day"? Well, that was to show his "bottom prediction powers" were off by a factor of two even with a slow moving index like the DJIA (he thought a 10% correction was the bottom and it went on to 20%). Well, why would anyone expect the QQQ call to be any better when even he said there is not enough data for this sector and it is a casino? He was RIGHT about THAT part... it IS a casino and he crapped out!

I speculated before that the boards would be up as an "open" forum. That is, open to nonsubscribers. That way, they can continue to censor and ban anyone they want without the problems they run into banning some subscribers but not others even though everyone pays the same $185.

At some point, however, the heavily censored boards will portray such a one-sided view that they will become, in essence, a false advertisement. Hey, there should be a law.

Centigrade & Mark - I promised you both that I would send you an invite to the Yahoo Brinkerbots Club. But Sorry - no can do - I just tried to login to the club and received an "Access Denied" notice. Hmmm - I was one of the first to sign up and this is my only post as reply to Bomira, who asked about other financial discussion boards on the net:

Hi bomira - This is my first post in the BBbots Yahoo club. This was a good idea, especially now that BB.com is restricted to subscribers only.

You asked what market oriented boards do we follow/contribute to.

For individual stocks I like the Raging Bull boards:
http://www.ragingbull.com

Yahoo! discussion boards
http://dir.yahoo.com/Business_and_Econom...

For individual stocks as well as more general discussion on investing I like:

The Motley Fool discussion boards
http://www.fool.com

Suite 101 Investing - Personal Finance Discussion
http://www.suite101.com/discussions.cfm/...

Suite 101 is where I usually hangout on the net. We have a Bob Brinker discussion thread also, if anyone's interested.......Jen

Well - as I said before, why bother with an exclusive censored site!.....Jen

I wonder if BB, put 50% of his own cash into the QQQ's? If he really believed in this trade, one would assume he participated it in. If he did, he probably lost millions of dollars.

Maybe he's trying to push his MT subscriptions to cover his QQQ losses?

What does everyone else on this board this about this?

Agree. Aside from nothing illegal as far as I can see, even if you could find a lawyer to make a stretch it would be wrong. Nobody put a gun to anyone's head.

In response to message posted by Kirk:

or taking "I can read the future" advice from a guy on the radio and thinking he owes you anything other than a refund for unsent newletters is wrong

Sorry Kirk, I strongly disagree with you on this point. If you are a business then you are always liable for providing bad service. If you're a dry cleaner and you put a big hole into someone's jacket then you should be liable to replace the jacket and not just refund the cost of the dry cleaning.

The law and lawsuits are the only thing protecting the general public and if that means fewer purveyors of financial advice then so be it.

Do you think Firestone should be liable for the accidents and deaths allegedly caused by their tires? Perhaps they should only be liable up to the cost of their tires? If so, what would prevent other tire manufacturers from cutting costs and producing bad tires? They're already weighing the costs of lawsuits vs lower margins.

I think people really underestimate the importance of laws and lawsuits in creating better and safer products, reducing the number of bad businesses and generally making life better over time.

Certainly, there are excesses but maybe McDonald's should have listened to the repeated complaints that the temperature of their coffee was unnecessarily high and was potentially dangerous.

The gypsy at the carnival isn't governed by the same rules as purveyors of financial advice. That's why he's at the carnival instead of on a nationally syndicated talkshow.

Note that the psychic services now state that "this is for entertainment purposes only" because they have to. Hey, that's an idea.
