Disability application problems

My initial claim was for three separate neck strain injuries I obtained while lifting patients. I am an RN. I have not worked since 9/98, I was terminated from my job in 3/99. My case went before a judge in 3/00 and claim for maximum disability, w/c was upheld for cervical strain. The FM diagnosis was not made till 4/00. I have to go for another independent medical review on 9/1/00. Will I be able to add fibromyalgia to the diagnosis list , or more directly, can I legally prove the FM is from the work related neck injuries. Opinion please.-- posted by momforce » cherrie - Disability Pensions Dear MOMFORCE (love your nickname)I have not dealt with workers comp. but have heard horror stories. that they send you to rehab.and it is extremely difficult. My advice for you is when you go for another medical review, whether you are able to do the tasks they request of you, you will in no doubt have a flare following your appointment. see you family doctor with your symptoms afterwards even if their is nothing,they can do for you. It is important that someone see what happens to you when you have to do things. This is even more important if they send you for a functional Evaluation,because you will be able to do the tasks required, but at what cost no doubt you will be in bed for several days.But with these appointments that insurance companies whant us to do there is no follow up to document the pain we go threw.I suggest you get help do not fight this alone.I had wonderful help from the disability advocates. good luck. -- posted by cherrie » cherrie - thank-you thank-you to tysonlowthanks for your comments. I woo felt has if I was copying with my limitations until all the hassles of my review. I look forward to my life getting back to some kind of normalcy well has normal as our lives can be. We too plan to scale down we are trying to sell our house it is just to much for me to manage since my oldest daughter moved out, and I can not afford any help. I want to focus on my health now and try to do more with my kids.After all the stress is over it is going to be time for me!!! massages regularly , hiring someone to clean the house.and relearn how to listen to my body before things get so bad. thank-you for your help I am still waiting but I am going to keep bugging, them I need this to be over. -- posted by cherrie » TysonLow - Disability Hi MomforceI would like to know do you live in Canada??.I do Ont,Canada. This would help to know- The rules could be different in other States. My attorney suggested that I have my treating dr. examine me the week of the IME for defense purposes, unfortunately I could only get an appointment the day before the exam. I have the most wonderful physical therapist that treats only fm patients and he said he would document any problems from the exam. His advice to me was not to let them get control. Unfortunately, even though his is an expert in Rx and functionality of patients with fibro, he says his testimony does not hold much weight with the judge because he is not an MD. Yes, my union was there for me unfortunately the hospital has a rule whereby an employee is terminated after 6 months of absence. This is legal according to state law. I am not a legal expert, but the w/c laws changed in 1996, and they are extremely complicated, and definitely NOT in favor of the injured worker. They necessitate the need of a lawyer for any appeal. And that means the lawyer gets 20% of your disability payments. All legal, all very common. I am hoping this will come to an end soon and the hospital will settle for a lump sum so I can get on with my life, and not have to endure any of this harassment any longer. -- posted by momforce » cherrie - disability dear Momforceplease I can not stress it enough you should get any Doctor to examine you preferably two days after you Medical exam. I would like to know what you had to say to them and the type of questions they asked you and what I should do to in order to better prepare my self. Did you have a strong case before hand? What kind of documents did you have support what you were saying?
