What Does The Seller Take to Closing...

All of your paperwork will be with the closing agent when you go in for your appointment. It should be noted, however, that you have a right to review your paperwork in advance of this meeting. Simply make this known to the closing agent a week or so before the scheduled date and they MUST comply.

You need to bring a current, photo identification with you to the closing. Typically, a driver’s license will suffice.

I suggest you bring any paperwork you feel you might need to refer to during the closing. This would include your original deed, (do not leave it there), warranty information, repair receipts, etc... Ideally, all of these items should have been reviewed and accounted well before the closing time, so this is really just a precautionary measure.

Garage door openers, alarm system combinations, keys and other secure items that will be transferred during the closing need to accompany you. If you are retaining possession for a while after closing you may elect to set a time for these transfers when possession actually takes place.

Let’s discuss “possession” a bit. It seems to me that agents were always putting “closing and funding” on the “possession” section of the contract. The problem with this is that everyone had a different idea of what “funding” was. Is it when the title company receives the buyer’s loan proceeds for their lender? Is it when the check from the title company is available for the seller to pick up? Is it when the title is physically recorded at the courthouse? All of these items could happen as quickly as simultaneously or as slowly as three or four days (or more) from each other.

This needs to be exactly clear in the contract. If the closing is delayed, often times the possession situation changes so make sure you stay on top of this.

Reminders Before you shut out the light and close the door on the sale of your home remember to disconnect utility services, cable television, water delivery and any other services you received at your home.

Leave the house clean and free of trash and run through it with a vacuum at the last minute. It is understandable that you are excited about moving to your new digs and don’t feel like doing anymore clean-up but I promise you that is it very important.

Having the buyer find the home in disarray will lead to complaints and a general negativity about the big purchase they just made. It can be a direct route to a lawsuit regarding something that might otherwise have been overlooked. In your haste to move on don’t be foolish--leave the house exactly how you would expect to find it--clean, clean, clean!
