New Jersey's partial-birth abortion ban overturned


As the result of a suit filed by Planned Parenthood and abortion providers, a federal court judge in Trenton, NJ overturned the state's partial-birth abortion ban last month.

Declaring the law unconstitutional because it was too vague and threatened a woman's right to chose to have an abortion, US District Court Judge Anne Thompson barred the law from taking effect.

After Governor Christine Todd Whitman refused to defend the law, the state Legislature hired a private attorney and appealed the decision. A ruling has not yet been made by the 3rd U.S. Circuit Court of Appeals. It is expected the court will announce its decision this summer.

Under the proposed law, a New Jersey doctor who performed a partial-birth abortion would lose his medical license and be fined $25,000.
