Ask that important points and authorities be placed in evidence on the record. Many times issues that are discussed in the hearings are not entered into the transcript.Ask your attorney what his plan of action is going to be. Ask him what evidence you will need to produce and who should be responsible for its production. Always double check with your attorney to ensure that you are always together on the issues.Ask your attorney if there is a penalty in your state for the delaying tactics of the responsible agencies. In some states there are fines that may be levied in this case.You have a right to competent legal representation. If you feel you are not being represented, you have a right to find another attorney. Always sign with another attorney before you fire your current attorney.Make sure that your employer has filed a WC report and that it is on record and is available to you.
Personal Financial Crisis Planning
If you are able to go back to work - do so as soon as possible.If your employer refuses to take you back or fires you, in some states you can apply for unemployment and collect disability simultaneously. Check with your state unemployment insurance staff.If you are seriously disabled and your doctor recommends that you are to be out of work for one year or more, file for Social Security Disability or SSI. If you have no medical insurance, inquire as to Medicare. When filing for Medicare, put down ALL medical problems that you currently have - not just your work-related injuries.Continue to appeal any adverse decisions regarding either SSD or SSI. It is possible that you may be required to hire a separate attorney to handle the SSD or SSI appeals process.Contact your creditors and ask if you have disability insurance for the balances with each one. Ask for the lowest available interest rate.Contact your automobile insurer and notify them that you are no longer putting the same amount of mileage on your car. This may lower your premiums for auto insurance.Contact your utility companies and ask if they have a budget plan for payments.For renters there are federal programs to help with your rent. The section 8-voucher program is one. Some Belmont Shelter Programs have very nice handicap rental properties where the
rent goes on the amount of your income.See if you can borrow on a life insurance policy if necessary to have access to funds.
