He also had reached the realization that rumrunning profits could not last forever since it tied up large amount of capital and the price of protection continued to increase. He sold his interest in the rumrunning activities to Waxey and settled on the profits he could rake in from rebottling and the interest in major clubs. He was out of the importing business, but soon devised a new plan to continue to make profits from distribution.

Rothstein was approached by one of his employees, John Noland, known to many as "Legs Diamond" with an idea that could turn a profit from the disorganization of the liquor distribution. There were still small gangs that were attempting to make a profit from bootlegging that did not have the muscle to retaliate with much force if their liquor was highjacked. Legs would turn the liquor over to AR for sale to gangs and share in the profits made through the sale. Rothstein liked the idea, so long as Diamond stayed away from the highly organized gangs that could retaliate in a forceful organized manner. Legs, however, overstepped his boundaries and began to hit larger gangs and increased the amount of violence in the competition for control of liquor. Now that Legs was more of a problem than he was worth AR made it clear that he would have not problem with larger gangs taking action against him.
