Modification (part 1) Outline of modification


I want to start this topic in parts because it is a very lengthy topic. I plan to cover three maybe four weeks with this topic. Its an essential part of every divorce so I want to spend quite a lengthy amount of time covering all the ins and outs. Since I have most of my experience in the Florida court, most of my references will be to that jurisdiction's process. Remember that this is not to substitute as legal advice but should only be a guide to the legal process. Should you have specific questions or want to know what applies to you, contact a legal professional in your area that is familiar with your jurisdiction. Here is a brief outline of what the next few weeks will cover:

When and why to modify This is going to discuss what leads to a modification, what must happen in order to modify and when is the best time to modify.

Procedures in modification* (* This might be covered in two weeks depending on length) This will be a discussion of the procedural steps to modification. My intention is to make it general but will be focused on FL law. It will go into several steps and the standards required by the court.

What you can expect in a modification I plan to discuss the emotions that will be connected with modification. Since modification is almost like getting divorced again, there are a lot of emotional issues tied to modification.

Special considerations in modification This shall cover special situations of modification like how to modify a decree from another jurisdiction and other special considerations.
