In 1988 the America's disabled community was told that our Constitutional Rights would be protected by a Bill which was eventually known as The American's With Disability Act. Did this act do what it said it would do? Do we now have the Right to employment with no insurance riders? Apparently not because of TitleV which states that one may be written up as a Risk for Private Insurance. How will this enable our disabled to become employed since many may already be considered to be risks. It won't so when it comes to our employment Rights then we still don't have protection. What good is a law which doesn't grant us employment protection or even employment Rights. If we don't have either then we may find oursleves doomed to a life of dependance upon Government even though we have The American's With Disabilities ACT.
In 1988,I spoke to EEOC in Charlotte North Carolina and pointed this out. To my surprise the head attorney,who was one of the writers of ADA,agreed that the writers had goofed when they incorporated Insurance language into the ACT. If the disabled can still be denied employment because of a preconcieved notion then how have our Inalienable Rights-Life,Liberty,and The Pursuit of happiness been protected?
