Death Penalty Drives Governor's Race In VirginiaWith these two polar opposite beliefs, the candidates have predictably begun a war of words over the issue. Kilgore has used Kaine's stance on the death penalty as an opening for a variety of attacks. Not only does Kilgore question Kaine's ability to obey the laws of the state when his religious beliefs are in direct contrast, but he also claims that Kaine will attempt to repeal all death penalty statutes if elected. Kilgore also believes that Kaine will misuse his powers as governor to further his anti-death penalty stance; since the governor of Virginia can grant a stay of execution in a capital case, Kilgore says that Kaine will use the governor's right to grant clemency as his own personal moratorium. In response, Kaine has said that he is very capable of withholding clemency: "I definitely could. We're not electing a king to do whatever they want. I would never use clemency unless someone was innocent." Kaine has also lashed out at Kilgore for criticizing his religious beliefs. "What [Kilgore] tries to do is suggest...that because someone has a religious belief, you can't trust him," he said. Despite their attacks on each other, however, each candidate is trying to be careful. Kaine knows he is walking a fine line between upholding the law and answering to his personal belief. Likewise, Kilgore doesn't want his pro-death penalty stance to cause a backlash in this era of DNA testing and increased scrutiny of evidence. Somewhat surprising, the polls show almost a dead heat between the two candidates--despite the overwhelming support the death penalty receives in Virginia. The latest Roanoke Times poll shows Kaine with a 1% lead over Kilgore. More surprising, however, is that more than half of the voters polled said they would consider voting for a candidate who objects to capital punishment on religious grounds but would not attempt to stop executions. Whether or not the Virginia voters would actually vote an anti-death penalty candidate into office remains to be seen, but as this election draws closer one thing is clear: this race for governor will hinge on one divisive issue.
