The Death Penalty In The Military


The most recent activity on the military death penalty front came last year. William Kreutzer, who was convicted of killing a soldier in a grenade attack on his own troops in 1995, had his death sentence vacated by an Army Court of Criminal Appeals. According to the Court, Kreutzer's attorneys "lacked the ability and experience to defend [a] capital case" and the convening authority improperly disallowed counsel to call an expert witness to testify to Kreutzer's mental health problems. Currently, Kreutzer is still on military death row awaiting re-trial.
