Drug Roadblock II"This is going to have a chilling effect on a kind of appropriately aggressive policing that's made people safer in their homes," Pasco said. "This casts a specter, at best, of judicial inconsistency and, at worst, a trend toward torturing the concept of civil liberties where people are no longer safe." The case of City of Indianapolis v. Edmond is yet another example in the tension between crime control and fundamental due process. When the public’s concerns for a pressing social problem such as drunk driving outweighs its concern for privacy crime control wins. Drugs remain a pressing problem in our society, but they do not carry the additional concern of safety on our highways that drunk driving does. Giving this the pendulum, for now, has swung in favor of due process. This is by no means the last word on this issue.
