When the truth isn't enough to set you free

Early on the morning of Sept. 30, 1979, Marine Corporal Kevin Green left his pregnant, 20-year-old wife, Dianna sleeping as he stepped out for a quick take-home snack from his local Jack in the Box. Green came home to find Dianna raped and severely beaten. A blow to the middle of her forehead had left Dianna unconscious and near death.

Dianna remained comatose for a month and suffered brain damage and memory loss. The baby, two weeks overdue, died before being delivered by C-section. When Dianna regained consciousness in the hospital, her hearing and sense of smell were damaged. She could not speak and had a difficult time communicating. She had no memory of the attack. Two months later, Dianna insisted that her last, vague memory before the attack was of her 22-year-old husband beating her with a wooden key caddy.

During his trial, Green's attorneys pointed out that the entire case against him relied on his wife's testimony. They provided corroboration by the cashier from Jack in the Box and reports by the police that Green's burgers were still warm when they arrived at the scene. The defense was denied a request to have Dianna, who had suffered serious head trauma, evaluated by an independent psychiatrist to determine her mental state. A rape kit that showed the presence of spermatozoa was used on Dianna following the incident, but Green did not have the $10,000 his attorney said he would need for DNA testing.

At the time of Dianna's attack, a serial rapist-killer known as the "Bedroom Basher" was breaking into Los Angeles homes, striking women on their heads, raping them, and killing them. The MO was similar to the assault on Dianna, but the prosecution was certain they had their man. Prosecutors revealed that Green and his wife fought frequently, particularly during the last two months before the attack. Many of the fights revolved around Dianna's refusal to have sex with her husband because of her pregnancy.

On October 2, 1980, a Santa Ana jury found Kevin Green guilty of second-degree murder for the death of the unborn fetus, and attempted murder and assault with a deadly weapon on his wife. A month later, the judge sentenced Green to 15-years-to-life in prison and sent him to San Quentin.

That same year, a former Marine named Gerald Parker was convicted for the kidnap/rape of a 13-year-old girl and sent to prison. In fact, Parker had been very busy. Unknown to authorities at the time, he killed at least five women, ages 17 to 31 between December 1978 and October 1979.
